CPSMA has received the following clarification in relation to requirements on part of the Employer to terminate all fixed term contracts at the end of the 2014/2015 school year – Circular 0023/2015 – Implementation of the Recommendations of the Expert Group on Fixed-Term and Part-Time Employment in Primary and Second Level Education in Ireland.

 

“For the avoidance of doubt, as set out in the Circular, employers must terminate all first year fixed-term contracts at the end of the 2014/2015 school year. Where the post will exist for the 2015/16 school year, the employer must re-advertise the post and conduct interviews. Where an employer proposes to place a teacher on a new one year fixed-term contract for the 2015/16 school year, the employer must be in a position to certify that the post was advertised, that interviews were conducted and that the teacher was successful following interview and is entering their second year of continuous employment. These requirements will also apply in subsequent years until further notice.

The new terms and conditions set out in Circular 0023/2015 create permanent employment in publicly funded posts. It is important that best practice norms relating to fairness, transparency and probity that attach to public appointments are fully followed and the procedures set out in the Circular are adhered to. Employers are reminded that the Department may audit (or have audited) the practices within schools and Education and Training Boards in relation to the Implementation of the Circular in regard to best practice, compliance and irregularities”
